When filing a new MDL case:

  • MDL cases must be filed using Colorado Courts e-filing system.
  • Do not submit a proposed Order.
  • Motion captions must include the case caption for each case being requested for consolidation including the names of all parties (no et al) click here for a sample caption.  
  • When a show cause order is issued, an MDL hearing date may be ordered (see the scheduled hearing dates below).   Typically a motion for consolidation must be filed a minimum of 35 days prior to be set for the next available hearing date. 

***Important ***

Service:  If your certificate of service indicates that you served the parties using Colorado Courts e-filing, you MUST serve them through the MDL matter – and NOT the trial court case.  You are not required to serve using e-filing for service; however, if you indicate that you served in that manner, you must serve them through the MDL case.  Otherwise, this is cause for rejection of your filing.  Additionally, the parties you are serving should be named specifically on your certificate of service.  Service of “all parties” is not accepted.
